The website located at kensingtonsound.studio (the "Site") is operated by Kensington Sound, a recording studio located at 170 Baldwin Street, Toronto, ON M5T 1L8, Canada. By accessing or using this Site and our studio services, you agree to be bound by the following terms of use. Kensington Sound reserves the right to modify these terms at any time. Your continued use of the Site following any changes constitutes acceptance of those changes. If you do not agree with any part of these terms, please do not use this Site or our services.

All content on this Site—including but not limited to text, images, graphics, logos, photographs, audio clips, video, and software—is the property of Kensington Sound or its content suppliers and is protected by applicable Canadian and international copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, modification, or use of any content from this Site is strictly prohibited without prior written consent from Kensington Sound.

Limited License

Kensington Sound grants you a limited, non-exclusive, non-transferable, revocable licence to access and use this Site for personal, non-commercial purposes only. This licence does not permit you to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, or create derivative works from the Site or its content;
  • Use any data mining, robots, or similar data-gathering or extraction methods on the Site;

Studio Booking & Cancellation

All studio sessions are by appointment only. Bookings are confirmed upon receipt of a deposit or written confirmation from our team.

  • Cancellations made more than 48 hours in advance of the scheduled session will receive a full refund of any deposit paid.
  • Cancellations made within 48 hours of the scheduled session may forfeit the deposit.
  • No-shows without prior notice will forfeit the full deposit.
  • Kensington Sound reserves the right to reschedule sessions due to unforeseen circumstances, in which case a full refund or rescheduled session will be offered.

Session times include setup and teardown. Please arrive promptly to make the most of your booked time.

Payment

Rates are quoted on a per-project or per-hour basis and are subject to change without notice. A deposit may be required to secure your booking. Full payment is due upon completion of the session or as otherwise agreed in writing. We accept payment by e-transfer, bank transfer, and other methods as communicated at the time of booking.

Intellectual Property & Ownership of Recordings

All recordings, mixes, and masters produced at Kensington Sound remain the intellectual property of the client, unless otherwise agreed in writing. Kensington Sound does not claim ownership of any music or audio content created during sessions. Kensington Sound may request permission to use excerpts, photos, or video from sessions for promotional purposes. Such use will only occur with the client's written consent.

Studio Conduct

Clients and their guests are expected to treat studio equipment and facilities with care and respect. Clients are responsible for any damage to studio equipment or property caused by themselves or their guests during a session. Kensington Sound is not responsible for personal belongings left on the premises. We recommend that clients keep valuables secure at all times.

File Storage & Backup

While we take reasonable precautions to protect session files, Kensington Sound is not responsible for data loss due to hardware failure, software issues, or other unforeseen events. Clients are strongly encouraged to maintain their own backups of all session files and recordings. Session files may be archived for a limited period following completion but are not guaranteed to be retained indefinitely.

Indemnity

You agree to indemnify, defend, and hold harmless Kensington Sound, its owners, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of this Site, your use of our studio services, or your violation of these terms.

Disclaimer

This Site and all content, materials, and services provided through it are made available on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Kensington Sound disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Kensington Sound shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this Site or our services, to the fullest extent permitted by law.

Governing Law

These terms of use are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
